Water Pure, Inc. dba Purity Products (“Purity Products,” “we,” “us,” or “our”) is committed to respecting your privacy.

This Consumer Health Data Privacy Policy supplements our general Privacy Policy and describes how we collect, use, disclose, and protect personal information that may qualify as “consumer health data” under applicable state consumer health data privacy laws, including the Washington My Health My Data Act and applicable laws in Nevada, Connecticut, and other states.

This Policy also describes the rights that may be available to you regarding your consumer health data.

CONSUMER HEALTH DATA WE COLLECT

Depending on how you interact with Purity Products, we may collect the following categories of consumer health data:

  • Health and wellness information you provide to us, including health goals, health concerns, symptoms, wellness interests, and other information you provide when taking a product quiz or assessment, requesting a product recommendation, contacting customer service, or otherwise interacting with us. This may include information relating to digestive health, sleep, joint health, immune support, hair health, healthy aging and longevity, and other health or wellness interests.
  • Health-related inferences, including information about your health goals, interests, or concerns that may be inferred from information you provide to us or your interactions with our websites, quizzes, products, or services.
  • Supplement and product information, including information regarding your use or purchase of dietary supplements or related products when that information identifies, or is used by us to infer, a health condition, health status, health goal, or health-related interest.
  • Product experience and safety information, including symptoms, product experiences, or adverse events that you voluntarily report to us.
  • Health-related inquiries, including customer service communications, requests for health or wellness information, and requests for product recommendations that may reveal information about your health, symptoms, health goals, or wellness concerns.

We do not intentionally collect consumer health data beyond what is reasonably necessary for the purposes described in this Policy or otherwise disclosed to you at the time of collection.

SOURCES OF CONSUMER HEALTH DATA

We may collect consumer health data from:

  • You directly, including when you take a product quiz or assessment, purchase or use our products, communicate with customer service, request product recommendations, submit a product review or other feedback, or otherwise provide information to us.
  • Your interactions with our websites and services, including through cookies and similar technologies where permitted by applicable law and consistent with your privacy choices.
  • Business and service partners, including e-commerce marketplaces, fulfillment and subscription providers, and other companies that assist us in providing products and services to you.
  • Advertising, social media, and marketing platforms, when permitted by applicable law and consistent with your consent and privacy choices.

PURPOSES FOR COLLECTING AND USING CONSUMER HEALTH DATA

We may collect and use consumer health data to:

  • provide and personalize product quiz or assessment results;
  • recommend products that may be relevant to your stated health and wellness goals;
  • provide products and services you request;
  • personalize our website, communications, and product content;
  • respond to customer service inquiries and product questions;
  • administer customer accounts, subscriptions, and purchases;
  • understand how customers use our products and services;
  • improve our products, quizzes, websites, services, and customer experience;
  • maintain the security and integrity of our websites and systems;

  • establish, exercise, or defend legal claims.

We may use information regarding adverse events or product safety concerns to satisfy applicable legal and regulatory obligations, including reporting and recordkeeping requirements applicable to dietary supplements.

We may also use consumer health data in aggregated or de-identified form for research, analytics, statistics, product development, and other lawful business purposes. We maintain de-identified information in de-identified form and do not attempt to re-identify it except as permitted by applicable law.

CONSENT

Where required by applicable law, we obtain your consent before collecting or sharing consumer health data, unless the collection or sharing is necessary to provide a product or service that you requested or another exception under applicable law applies.

For example, when you voluntarily provide health or wellness information through one of our product quizzes or assessments, we may ask you to affirmatively consent to our collection and use of that information for the purposes described at the time of collection.

Where applicable law requires separate consent before sharing consumer health data with certain third parties, we will obtain that consent before doing so.

DISCLOSURE OF CONSUMER HEALTH DATA

Depending on the services you use and the choices you make, we may disclose consumer health data to the following categories of recipients:

  • Service providers and processors that perform services on our behalf, such as website and quiz hosting, information technology, data storage, order fulfillment, customer service, subscription management, email and SMS communications, and analytics. These providers may process consumer health data only as necessary to perform services for us and subject to applicable contractual and legal restrictions.

The categories of consumer health data disclosed may include health and wellness information you provide, quiz or assessment responses, health-related product interests and recommendations, health-related communications, and product safety or adverse-event information, depending on the purpose of the disclosure and the recipient.

We do not sell consumer health data for monetary consideration. We also do not sell or share consumer health data in circumstances requiring affirmative consent under applicable consumer health data laws unless we first obtain the consent required by law.

CONSUMER HEALTH DATA AND ADVERTISING

We recognize that information about a person's health or wellness interests can be particularly sensitive.

Where applicable law requires consent before consumer health data may be disclosed to an advertising, analytics, social media, or similar third-party platform, we will obtain the required consent before making that disclosure.

Certain rights may be subject to exceptions. For example, we may retain information when required to do so by law, including records relating to product safety or adverse-event reporting, or when otherwise permitted by applicable law.

SECURITY OF CONSUMER HEALTH DATA

We use reasonable administrative, technical, and organizational safeguards designed to protect consumer health data against unauthorized access, use, alteration, disclosure, or destruction.

However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

HEALTH-RELATED GEOFENCING

We do not use geofencing technology around healthcare facilities to identify, track, collect consumer health data from, or send health-related advertising to consumers in a manner prohibited by applicable consumer health data laws.

SUPPLEMENT FOR NEVADA CONSUMERS

Nevada residents may have additional rights under Nevada law regarding consumer health data, including the right to review and request correction of consumer health data we maintain about them.

Nevada residents may also have the right to appeal certain decisions regarding consumer health data requests. If an appeal is unsuccessful, Nevada residents may contact the Nevada Attorney General.

Nothing in this Policy is intended to limit any additional consumer rights provided under applicable Nevada law.
